Facts about the Assessment
Q1. Why has the WWRA assessed a $55 charge?
The WWRA board became aware that if there was an accident on the common areas and a successful lawsuit was filed against Wetherbyrne Woods, each property owner would be assessed an equal share of the award. More troubling though was the fact that INDIVIDUAL HOMEOWNER POLICIES DO NOT COVER this liability (even umbrella policies). Since Wetherbyrne Woods owns 2 parcels of land plus some fixed structures, we are potential litigants. In order to obtain liability insurance coverage, the insurance companies require participation by all owners.
Q2. How did we arrive at the $55 amount?
We divided the annual expenses into 2 categories:
1. Mandatory costs: They include insurance, legal, landscaping, water and electric, covenant enforcement, required state registration and the annual meeting. These expenses cover things that are required by our Covenants and Bylaws, keep Wetherbyrne in-code with Cobb County and they equally benefit all residents.
2. Association costs: They include newsletters, directories, welcoming committee, sunshine committee, annual clean up, annual garage sale, et al. These expenses cover all things that are more social in nature for the WWRA members and are not required to protect our property values.
We then calculated each category’s percentage of the total expenses per year and arrived at a $55/$20 split
Q3. WWRA has not had an assessment before, why now?
Our expenses for the insurance are significant (close to $2,000) and require mandatory participation (see our annual budget posted on the WWRA website www.wetherbyrnewoods.com). It was determined by vote at the Annual Meeting that ALL residents should participate in supporting the mandatory costs of maintaining our neighborhood.
Q4. Who gets to vote on issues?
All residents who are DUES-Paying members. A resident must pay the Dues of $75/yr (which includes the $55 assessment) to qualify to vote.
Q5. Is payment of the Assessment required?
Yes. As per our bylaws and covenants, which are part of each deed within Wetherbyrne Woods. WWRA is authorized to assess all owners. Please see the Bylaws and Covenants on the www.wetherbyrnewoods.com web site.
Q6. Are there penalties for non-payment?
Yes. A $35 late fee and a 1.5% penalty per month for any part of a month not paid within 30 days of the due date. In addition, any legal and/or court costs will be the responsibility of the owner. And finally, a clearance letter upon sale of the property will NOT be issued unless all past-due fees are paid.
Q7. Do you expect this to become an annual assessment?
Yes.

Q9. When do I pay?
If you have not already paid, then the mandatory assessment is due immediately.
